Planning Appeals with AATP

If planning permission is refused, there is a right of appeal to the Planning Inspectorate. While we see planning appeals as the last resort if negotiations breakdown, or if there are significant delays, a planning appeal may be the only appropriate method to reach a decision.

Planning Enforcement

If you are facing enforcement action it is crucial that you do not ignore it. Once an enforcement notice takes effect, your options start being eroded along with your ability to successfully overcome the action. Enforcement action is discretionary and early intervention, negotiation and compromise is normally preferable to fighting an enforcement appeal.

Types of Enforcement Action

There is a wide range of enforcement powers available to Local Authorities. They include Planning Contravention Notices, Enforcement Notices, Breach of Condition Notices, and Stop Notices. An appropriate planning strategy will depend on the nature of any alleged breach and action already taken by the Council.
